Introduction

Welcome to SwiftPH Academy. These Terms of Service ("Terms") govern your access to and use of our website, services, courses, and content (collectively, the "Services"). Please read these Terms carefully before using our Services.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.

Use of Services

Eligibility

You must be at least 16 years old to use our Services. By using our Services, you represent and warrant that you meet this eligibility requirement. If you are under 18 years old, you must have permission from a parent or guardian to use our Services, and they must agree to these Terms on your behalf.

Courses and Content

Enrollment and Payment

When you enroll in a course, you agree to pay the specified fees. All fees are in Philippine Pesos (₱) unless otherwise stated and are non-refundable except as provided in our refund policy.

Payment must be made using one of our accepted payment methods. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

Course Access

Upon enrollment and payment, we grant you a limited, non-exclusive, non-transferable license to access and view the course content for personal, non-commercial, educational purposes. This license is for your individual use only and may not be assigned or transferred to any other person.

Access to course content is provided for the duration specified at the time of enrollment. For courses with "lifetime access," this means as long as SwiftPH Academy continues to offer the course on its platform.

Intellectual Property

All content included in our Services, such as text, graphics, logos, images, audio clips, video, data, and software, is the property of SwiftPH Academy or its content suppliers and is protected by intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials
You may store files that are automatically cached by your web browser for display enhancement purposes
You may print or download one copy of a reasonable number of pages of the course materials for your personal, non-commercial use and not for further reproduction, publication, or distribution

You must not:

Modify copies of any materials from our Services
Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from our Services
Access or use for any commercial purposes any part of our Services

User Contributions

Our Services may contain discussion forums, chat rooms, personal profiles, or other interactive features that allow users to post, submit, publish, display, or transmit content or materials.

Any User Contribution you post to the site will be considered non-confidential and non-proprietary. By providing any User Contribution, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material.

Refund Policy

SwiftPH Academy offers a 14-day refund policy for all course enrollments. If you're unsatisfied with a course, you can request a full refund within 14 days of the date of enrollment.

To be eligible for a refund, you must submit a request via our website or by emailing us, explaining the reason for your dissatisfaction. Refunds are processed within 7-14 business days of approval.

We reserve the right to deny refund requests that we determine are not made in good faith or are based on issues that could reasonably have been discovered before enrollment.

Disclaimers and Limitation of Liability

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER SWIFTPH ACADEMY NOR ANY PERSON ASSOCIATED WITH SWIFTPH ACADEMY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES.

WITHOUT LIMITING THE FOREGOING, NEITHER SWIFTPH ACADEMY NOR ANYONE ASSOCIATED WITH SWIFTPH ACADEMY REPRESENTS OR WARRANTS THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

SWIFTPH ACADEMY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.

Limitation of Liability

IN NO EVENT WILL SWIFTPH ACADEMY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

Indemnification

You agree to defend, indemnify, and hold harmless SwiftPH Academy, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

Changes to the Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Services thereafter.

Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of the Philippines. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
